By booking any tour, excursion, activity, or service with Magical Tours Bulgaria (Montravel EOOD), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. Please read them carefully before making any reservation.

1. Definitions & Interpretation

In these Terms and Conditions, the following definitions apply:

  • “Company”, “We”, “Us”, “Our” – Montravel EOOD, a limited liability company incorporated under Bulgarian law (EOOD), trading as Magical Tours Bulgaria, with registered address at 17 G. Benkovski Str., Dulovo 7650, Bulgaria.

  • “Client”, “You”, “Your” – any individual or group who books, purchases, or participates in any tour, activity, or service offered by the Company.

  • “Tour” – any guided excursion, hiking trip, cave tour, nature walk, mountain activity, day trip, multi-day package, or other tourist service arranged by the Company.

  • “Booking” – a confirmed reservation made by the Client for a Tour, accepted in writing (including email) by the Company.

  • “Booking Confirmation” – the written or electronic document issued by the Company confirming acceptance of a Booking.

  • “Force Majeure” – any event beyond the reasonable control of the Company, including but not limited to acts of God, extreme weather, earthquakes, floods, fire, epidemic, pandemic, government action, war, terrorism, civil unrest, border closure, or infrastructure failure.

  • “Third-Party Supplier” – any independent accommodation provider, transport company, guide, activity operator, or other service provider contracted by the Company to deliver elements of a Tour.

  • “Package” – a combination of at least two different types of tourist services sold as a single arrangement, as defined in the Bulgarian Tourism Act.

  • “Inherent Risk” – risks that are an integral feature of an activity and cannot be eliminated without fundamentally changing the nature of the activity, including the risks described in Clause 11.

These Terms and Conditions are governed by the laws of the Republic of Bulgaria, including the Bulgarian Tourism Act (Zakon za Turizma), the Bulgarian Obligations and Contracts Act (Zakon za Zadalzheniata i Dogovorite – ZZD), the Bulgarian Consumer Protection Act, and applicable EU directives including the Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

The Company is registered as a tour operator in accordance with the Bulgarian Tourism Act. A copy of the Tour Operator Liability Insurance policy is filed annually with the Ministry of Tourism as required by Bulgarian law.

3. Acceptance of These Terms & Conditions

These Terms and Conditions constitute a legally binding contract between you and Montravel EOOD. By taking any of the following actions, you are deemed to have accepted these Terms and Conditions in full:

  • Completing and submitting a booking form on our website or by email.

  • Paying a deposit or full payment for any Tour.

  • Signing or electronically accepting any booking agreement, participation waiver, or contract issued by the Company.

  • Participating in any Tour or activity organized by the Company.

Where a booking is made on behalf of other participants (e.g., a group leader), the person making the booking warrants that they have the authority to bind all participants to these Terms and Conditions, and that all participants have been informed of and agree to these Terms and Conditions and any applicable activity waivers.

These Terms and Conditions take precedence over any prior verbal or written representations unless expressly stated otherwise in a signed written agreement.

4. Bookings, Reservations & Payments

4.1 Making a Booking

All bookings must be submitted in writing, either via our website booking form or by email to info@magicaltoursbulgaria.com. A booking is not confirmed until the Company issues a written Booking Confirmation and receives the required deposit or full payment.

The Company reserves the right to decline any booking at its absolute discretion without being required to provide a reason. If a booking is declined, any payments received will be returned in full within 14 days.

4.2 Deposit & Payment Schedule

  • A non-refundable deposit of 30% of the total tour price is required to confirm a booking, unless otherwise stated in writing.

  • The remaining balance is due no later than 30 days before the scheduled departure date.

  • For bookings made within 30 days of departure, full payment is due at the time of booking.

  • Failure to pay the balance by the due date may result in the booking being cancelled and the deposit being forfeited.

4.3 Prices & Currency

All prices are quoted in Euro (EUR) or Bulgarian Lev (BGN) as specified. The Company reserves the right to adjust prices prior to a Booking Confirmation being issued. Once a Booking Confirmation is issued, the price is fixed, except in the following circumstances:

  • Significant changes in transportation costs, including fuel prices.

  • Changes in taxes, fees, or levies imposed by applicable authorities.

  • Significant exchange rate fluctuations exceeding 2% against the quoted price.

Price increases of 8% or more of the total tour price will entitle the Client to cancel without penalty and receive a full refund. Price increases of less than 8% will not entitle the Client to cancel without penalty.

4.4 Accepted Payment Methods

The Company accepts payment by bank transfer, credit or debit card (via secure online payment processor), or cash for local day tours. Card payments may be subject to a processing fee, which will be disclosed at the time of booking. The Company does not store card details.

5. Cancellation Policy

5.1 Cancellation by the Client

All cancellations must be submitted in writing to info@magicaltoursbulgaria.com. The date of cancellation is the date on which the Company receives your written notification. The following cancellation fees apply:

We strongly recommend that all Clients purchase comprehensive travel insurance that includes cancellation cover. The Company cannot waive cancellation fees due to personal circumstances, illness, family emergencies, or any other reason, unless a separate written agreement has been made in advance.

5.2 Cancellation by the Company

The Company reserves the right to cancel any Tour in the following circumstances:

  • The minimum number of participants required to operate the Tour has not been reached. Clients will be notified at least 20 days before departure (7 days for short tours under 6 days) and offered either a full refund or an alternative tour of equivalent value.

  • Force Majeure events render operation of the Tour impossible, unsafe, or inadvisable. In this case, the Company will offer a full refund or an alternative tour, but shall not be liable for any additional costs incurred by the Client (e.g., flights, accommodation booked independently).

  • Safety concerns – including but not limited to dangerous weather, trail closure, government travel advisory, or other conditions deemed unsafe by the Company’s guides or management. Safety is our absolute priority.

The Company is not responsible for any consequential losses, including independently booked flights, accommodation, visas, or other travel arrangements, in the event of a Tour cancellation.

5.3 Modifications by the Client

Requests to change a booking (e.g., date, participant number) must be submitted in writing. The Company will endeavour to accommodate changes but cannot guarantee availability. An administration fee of BGN 30 (or EUR 15) per change per person may apply. Changes within 30 days of departure are treated as cancellations and new bookings.

5.4 Modifications by the Company

The Company reserves the right to modify Tour itineraries, accommodation, routes, or activity schedules where circumstances require. Where changes are significant, Clients will be notified as promptly as possible. A ‘significant change’ includes a change in departure/return dates of more than 24 hours, or a substantial change in the standard of accommodation or primary activities. In such cases, Clients may accept the changes or cancel and receive a full refund.

6. Travel Insurance

TRAVEL INSURANCE IS MANDATORY. All Clients must hold valid comprehensive travel insurance covering: personal accident and medical expenses, emergency evacuation and repatriation, trip cancellation and curtailment, loss of baggage and personal belongings, and liability to third parties. Participation in any Tour without adequate travel insurance is entirely at the Client’s own risk. The Company will not be liable for any costs that would have been covered by adequate insurance.

Proof of travel insurance may be requested by the Company prior to or at the start of the Tour. If a Client is unable to provide proof of adequate insurance, the Company reserves the right to refuse participation without any obligation to issue a refund.

For tours involving hiking, mountaineering, cave exploration, or other adventure activities, Clients must ensure their insurance policy specifically covers these activities. Standard travel insurance often excludes adventure sports – please check your policy carefully.

The Company holds Tour Operator Professional Liability Insurance as required by Article 97 of the Bulgarian Tourism Act. This policy covers the Company’s contractual liability to Clients but does not replace the Client’s obligation to hold personal travel insurance.

7. Client Responsibilities

7.1 General Obligations

All Clients are responsible for the following:

  • Ensuring they hold valid travel documents (passport, visa, ID card) as required for travel to Bulgaria and any other country included in the Tour.

  • Ensuring they meet the physical fitness and health requirements for their chosen Tour. The Company publishes fitness level descriptions for all Tours – Clients must assess these honestly.

  • Disclosing any medical conditions, disabilities, allergies, dietary requirements, or physical limitations that may affect participation in the Tour or the safety of others. The Company will treat such information confidentially.

  • Arriving at the agreed meeting point at the agreed time. The Company is not obliged to wait and will not issue refunds for late arrivals who miss a Tour.

  • Following all instructions given by Company guides and staff at all times. Failure to comply with guide instructions may result in removal from the Tour without refund.

  • Behaving in a manner that does not endanger themselves, other participants, guides, or third parties.

  • Respecting the natural environment, local laws, cultural customs, and protected areas visited during the Tour.

  • Carrying adequate personal equipment as specified in the Tour briefing (e.g., appropriate footwear, clothing, water, first aid supplies).

7.2 Physical Fitness & Medical Suitability

Many of our Tours involve strenuous physical activity including mountain hiking, steep ascents and descents, cave exploration in confined spaces, exposure to cold or wet conditions, and traversal of uneven terrain. By booking such a Tour, the Client represents and warrants that they are in good physical health and are not aware of any condition that would make participation unsafe.

Clients with pre-existing heart conditions, respiratory conditions, musculoskeletal problems, pregnancy, or any other condition that may be affected by strenuous exercise should consult their physician before booking and must disclose such conditions to the Company. The Company reserves the right to refuse participation if, in the reasonable opinion of its guides, a Client’s condition poses a risk to themselves or others.

7.3 Minors

Participants under the age of 18 must be accompanied by a parent or legal guardian, or must have a signed parental consent form authorizing their participation. The parent or guardian assumes full responsibility for the minor’s safety, behaviour, and compliance with these Terms and Conditions and any activity waivers. For tours involving adventure activities, we recommend that the suitability of the activity for the specific child is confirmed in advance with the Company.

8. Company Obligations & Service Standard

The Company commits to the following:

  • To organize and deliver Tours with reasonable skill, care, and diligence in accordance with the Bulgarian Tourism Act and applicable EU law.

  • To employ suitably qualified, licensed, and experienced guides for all Tours.

  • To provide accurate and up-to-date information about Tour content, difficulty level, and requirements.

  • To respond to Client enquiries within 2 working days.

  • To maintain Tour Operator Liability Insurance as required by law.

  • To notify Clients promptly of any significant changes to a confirmed booking.

  • To prioritize Client safety above all other considerations.

The Company acts as the principal organizer for its own Tours. Where Third-Party Suppliers are involved, the Company exercises reasonable care in their selection but cannot guarantee the performance of independent third parties.

9. Liability & Limitation of Liability

9.1 Company Liability

The Company is liable to Clients for the proper performance of the services covered by the booking contract, in accordance with Articles 88-102 of the Bulgarian Tourism Act and the EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

Where the Company is found to be liable for improper performance of contracted services, liability shall be limited as follows:

  • For personal injury or death caused directly by the gross negligence or wilful misconduct of the Company or its employees – unlimited liability applies.

  • For all other damages (property loss, consequential loss, disappointment, distress, loss of enjoyment) – liability is limited to the total price paid by the Client for the Tour.

  • For services provided by Third-Party Suppliers – liability is limited to the maximum available under the relevant international conventions and the Third-Party Supplier’s own terms.

In no event shall the Company be liable for indirect, consequential, special, or punitive damages, including loss of income, loss of enjoyment, or costs incurred in relation to independently booked travel arrangements (flights, accommodation, etc.) not forming part of the booked Tour.

9.2 Third-Party Suppliers

Where a Tour includes services provided by Third-Party Suppliers (such as accommodation providers, transport companies, external activity operators), the Company acts as an organizer and exercises reasonable care in selecting reliable suppliers. However, the Company cannot guarantee the actions, omissions, or quality of Third-Party Suppliers and shall not be liable for any loss, injury, or inconvenience arising from the acts or omissions of such suppliers, except to the extent required by the Bulgarian Tourism Act.

9.3 Exclusions from Liability

The Company shall not be liable for any loss, damage, injury, death, or inconvenience arising from:

  • Events of Force Majeure, as defined in Clause 1.

  • The Client’s own acts, omissions, or negligence.

  • The acts or omissions of a third party unconnected with the provision of the Tour.

  • Failure by the Client to follow guide instructions, safety briefings, or published Tour requirements.

  • The Client’s failure to disclose relevant medical conditions or physical limitations.

  • The Client’s failure to hold adequate travel insurance.

  • Inherent risks of the activities described in Clause 11 that are voluntarily assumed by the Client.

10. Force Majeure

The Company shall not be in breach of its obligations, nor shall it be liable for any failure or delay in performing its obligations, where such failure or delay results from a Force Majeure event. Force Majeure events include, but are not limited to:

  • Acts of God – earthquake, flood, fire, lightning, storm, landslide, avalanche, or other extreme natural events.

  • Epidemic, pandemic, or public health emergency declared by competent Bulgarian or international authorities.

  • War, armed conflict, terrorism, civil unrest, riot, or political instability.

  • Government action – travel bans, border closures, mandatory quarantine, or other regulatory restrictions.

  • Trail or road closures by relevant Bulgarian national park authorities, forestry services, or emergency services.

  • Extreme or dangerous weather conditions that, in the sole and reasonable judgment of the Company’s guides, render a Tour unsafe.

  • Industrial action, strikes, or failure of public utilities.

In the event of Force Majeure, the Company will endeavour to notify Clients as soon as reasonably practicable. The Company will offer alternative arrangements where possible, or a full refund of sums paid for the specific Tour affected. The Company shall not be responsible for any additional costs incurred by the Client (e.g., independently booked flights or accommodation) as a result of Force Majeure cancellations or modifications.

11. COVID-19, Pandemic & Infectious Disease Policy

This section applies to COVID-19 and any other infectious disease, epidemic, or pandemic that may affect the safe delivery of Tours or the health of participants and staff.

11.1 Client Health Declaration

By participating in any Tour, the Client confirms and warrants that:

  • To the best of their knowledge, they are not suffering from, and have not recently been diagnosed with, COVID-19 or any other highly contagious illness.

  • They have not been in close contact with a confirmed case of COVID-19 or other notifiable infectious disease within 10 days prior to the Tour departure date.

  • They will comply with all health and safety protocols required by Bulgarian law, national park regulations, or the Company at the time of the Tour.

  • They will immediately inform the Company or their guide if they develop symptoms of illness during a Tour.

11.2 Company Rights During a Health Emergency

The Company reserves the right to:

  • Refuse participation to any Client who presents symptoms of infectious illness at the time of the Tour, without obligation to issue a refund. This decision is made solely to protect the health and safety of other participants and staff.

  • Cancel, modify, or postpone any Tour in response to government-imposed restrictions, public health authority guidance, or border closures related to any infectious disease or public health emergency.

  • Require Clients to provide proof of vaccination, negative test results, or other documentation required by Bulgarian authorities as a condition of participation.

  • Implement additional safety protocols at any time (e.g., face coverings in enclosed spaces, reduced group sizes, enhanced sanitation) in compliance with Bulgarian health regulations.

11.3 Cancellation Due to Pandemic/Epidemic

If a Tour is cancelled or significantly modified by the Company as a direct result of a government-declared pandemic, epidemic, or public health emergency, the Client will be offered:

  • A full credit note redeemable against any future Tour within 24 months; or

  • A full refund of monies paid, less any unrecoverable costs already committed by the Company (e.g., pre-paid permits, guide fees), which will be documented and disclosed to the Client.

If a Client is unable or unwilling to participate in a Tour due to personal concern about infectious disease, and the Tour is not cancelled by the Company, the standard cancellation policy in Clause 5.1 will apply. The Company therefore strongly recommends purchasing travel insurance that covers ‘pandemic-related cancellation’.

11.4 Inherent Health Risks

Participation in outdoor activities in mountain, cave, and forest environments involves proximity to other participants and, occasionally, to members of the public. The Company cannot guarantee a risk-free environment with respect to infectious diseases. The Client assumes this inherent risk by choosing to participate.

12. Adventure Activity Disclaimer & Assumption of Risk

WARNING – PLEASE READ CAREFULLY: The activities offered by Magical Tours Bulgaria include hiking in mountain terrain, cave exploration, forest trekking, and other adventure activities that carry inherent risks of personal injury, illness, or death that cannot be fully eliminated even with expert guidance and proper precautions. You must read and understand this section before booking.

12.1 Inherent Risks of Mountain Hiking

Mountain hiking in the Bulgarian Balkans, Rila, Rhodopes, and other mountain regions involves, but is not limited to, the following inherent risks:

  • Falls on steep, rocky, wet, or icy terrain, which may result in injury or death.

  • Rockfall, landslide, or avalanche in mountain and gorge environments.

  • Sudden and severe changes in weather conditions, including thunderstorms, strong winds, fog, hail, and rapid temperature drops.

  • Altitude-related symptoms including fatigue, dehydration, and altitude sickness on higher peaks.

  • Lightning strikes in exposed alpine terrain.

  • Hypothermia or frostbite in cold or wet conditions.

  • Muscle injury, sprains, fractures, or other physical injury from terrain challenges.

  • Encounters with wildlife, including venomous snakes, insects, and bears in certain areas.

  • Difficulty of evacuation in remote terrain – rescue may take several hours.

12.2 Inherent Risks of Cave & Gorge Exploration

Cave tours, gorge crossings, and subterranean activities involve additional risks, including:

  • Slippery and uneven surfaces in caves and gorges, significantly increasing the risk of falls.

  • Low clearance areas and confined spaces requiring crawling, crouching, or squeezing.

  • Darkness and limited visibility in underground environments.

  • Risk of flash flooding in cave and gorge systems following rain.

  • Potential for entrapment or disorientation in underground environments.

  • Falling rocks or debris from cave ceilings and gorge walls.

  • Cold and damp conditions that may affect those with respiratory or circulatory conditions.

12.3 Voluntary Assumption of Risk

By booking and participating in any Tour offered by Magical Tours Bulgaria, the Client expressly:

  1. Acknowledges that they are fully aware of the inherent risks of the specific activity they have chosen, including all risks described in Clauses 12.1 and 12.2 and any risks described in the specific Tour itinerary.

  2. Accepts and voluntarily assumes all inherent risks associated with the Tour and its activities, including risks arising from the negligence (but not gross negligence or wilful misconduct) of the Company, its employees, agents, or guides.

  3. Agrees that they have assessed their own physical fitness, experience, and capabilities against the published Tour requirements and have determined, in their own judgment, that participation is appropriate for them.

  4. Agrees to follow all safety instructions, guidelines, and decisions made by Company guides without argument or delay. Guide decisions on safety matters are final.

  5. Agrees that if they choose to leave a Tour, proceed beyond designated points, or engage in activities against guide advice, they do so entirely at their own risk and release the Company from all liability for any resulting loss, injury, or death.

Nothing in this Clause shall exclude or limit the Company’s liability for death or personal injury caused by the gross negligence or wilful misconduct of the Company or its employees, as provided by Bulgarian law.

12.4 Equipment & Preparation

Clients must arrive at each Tour with appropriate personal equipment as specified in the Tour briefing. The Company may refuse entry to any Client who arrives inappropriately equipped (e.g., wearing unsuitable footwear for a mountain hike). No refund will be issued in such circumstances. The Company is not responsible for any loss, damage, or injury arising from inadequate personal equipment.

12.5 Guide Authority on Safety

All decisions regarding the safety of a Tour – including the decision to modify a route, turn back, halt a Tour, or exclude a participant – rest solely with the Company’s guide. These decisions are made with the safety of all participants in mind and are not negotiable. Clients who refuse to comply with a guide’s safety decision may be excluded from the Tour without refund.

13. Complaints & Dispute Resolution

13.1 Complaints During a Tour

If you have a complaint about any aspect of your Tour, you must raise it immediately with your guide or Company representative. Prompt notification allows the Company the opportunity to rectify the problem. The Company cannot consider complaints relating to matters that were not raised on-tour unless there was a compelling reason that prevented you from doing so.

13.2 Formal Complaints

Formal complaints must be submitted in writing to info@magicaltoursbulgaria.com within 28 days of the end of the Tour. The Company will acknowledge receipt within 5 working days and provide a full response within 28 days. Complaints received more than 28 days after the Tour ends will not normally be considered.

13.3 External Dispute Resolution

If a complaint is not resolved to your satisfaction, you have the following options:

  • Lodge a complaint with the Commission for Consumer Protection (CCP) of Bulgaria, the competent authority for consumer rights: Sofia 1000, 4A Slaveykov Square – www.kzp.bg.

  • Contact the European Online Dispute Resolution platform (for online contracts): www.ec.europa.eu/consumers/odr.

  • Pursue a claim through the Bulgarian courts. The governing law is Bulgarian law and the courts of the Republic of Bulgaria shall have exclusive jurisdiction.

14. Intellectual Property & Photography

All content on the Company’s website and marketing materials – including photographs, videos, written descriptions, route maps, and itineraries – is the property of Montravel EOOD or used with permission. No content may be reproduced, distributed, or used commercially without the prior written consent of the Company.

During Tours, the Company’s guides or staff may take photographs or video footage for marketing and social media purposes. By participating in a Tour, you grant the Company permission to use such images and footage, in which you may appear, for non-commercial promotional purposes. If you do not wish to be photographed, please inform your guide at the start of the Tour. Images of identifiable individuals will be handled in accordance with our Privacy Policy.

15. Data Protection

The Company collects and processes personal data in accordance with EU Regulation 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act. By making a booking, you consent to the Company processing the personal data necessary to fulfil your booking and comply with legal obligations. Your data will not be sold to third parties.

16. Health, Safety & Environmental Responsibility

The Company is committed to the safety of its Clients, guides, and the natural environment. All Clients are expected to:

  • Carry sufficient water (minimum 2 litres per person for mountain tours), personal medication, and emergency snacks.

  • Inform the guide of any medical condition, allergy, or medication that may become relevant during the Tour.

  • Not consume alcohol before or during strenuous outdoor activities. Any Client who is visibly intoxicated will be excluded from the Tour without refund.

  • Not smoke in forested areas, national parks, or any locations where smoking is prohibited by Bulgarian law.

  • Take all litter home or to designated disposal points. The Company practices Leave No Trace principles.

  • Respect wildlife and adhere to national park regulations. Feeding or disturbing wildlife is strictly prohibited.

  • Not deviate from designated routes without explicit guide permission.

17. Governing Law & Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Bulgaria. The parties submit to the exclusive jurisdiction of the Bulgarian courts for the resolution of any dispute arising out of or in connection with these Terms and Conditions.

Applicable legislation includes, but is not limited to:

  • Bulgarian Tourism Act (Zakon za Turizma) – as amended.

  • Bulgarian Obligations and Contracts Act (Zakon za Zadazheniata i Dogovorite).

  • Bulgarian Consumer Protection Act.

  • EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

  • EU General Data Protection Regulation 2016/679 (GDPR).

If any provision of these Terms and Conditions is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Amendments to These Terms & Conditions

The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the Company’s website with a revised effective date. The Terms and Conditions applicable to any confirmed booking are those in force at the time the Booking Confirmation was issued, except where changes are required by law or by material changes in circumstances affecting the Tour.

19. Entire Agreement

These Terms and Conditions, together with the Booking Confirmation, any activity-specific participation waivers, and the Company’s Privacy Policy, constitute the entire agreement between the Client and the Company with respect to the Tour. They supersede all prior representations, negotiations, understandings, and agreements, whether oral or written.

No variation to these Terms and Conditions shall be effective unless made in writing and signed by an authorized representative of Montravel EOOD.

1. Definitions & Interpretation

In these Terms and Conditions, the following definitions apply:

  • “Company”, “We”, “Us”, “Our” – Montravel EOOD, a limited liability company incorporated under Bulgarian law (EOOD), trading as Magical Tours Bulgaria, with registered address at 17 G. Benkovski Str., Dulovo 7650, Bulgaria.

  • “Client”, “You”, “Your” – any individual or group who books, purchases, or participates in any tour, activity, or service offered by the Company.

  • “Tour” – any guided excursion, hiking trip, cave tour, nature walk, mountain activity, day trip, multi-day package, or other tourist service arranged by the Company.

  • “Booking” – a confirmed reservation made by the Client for a Tour, accepted in writing (including email) by the Company.

  • “Booking Confirmation” – the written or electronic document issued by the Company confirming acceptance of a Booking.

  • “Force Majeure” – any event beyond the reasonable control of the Company, including but not limited to acts of God, extreme weather, earthquakes, floods, fire, epidemic, pandemic, government action, war, terrorism, civil unrest, border closure, or infrastructure failure.

  • “Third-Party Supplier” – any independent accommodation provider, transport company, guide, activity operator, or other service provider contracted by the Company to deliver elements of a Tour.

  • “Package” – a combination of at least two different types of tourist services sold as a single arrangement, as defined in the Bulgarian Tourism Act.

  • “Inherent Risk” – risks that are an integral feature of an activity and cannot be eliminated without fundamentally changing the nature of the activity, including the risks described in Clause 11.

These Terms and Conditions are governed by the laws of the Republic of Bulgaria, including the Bulgarian Tourism Act (Zakon za Turizma), the Bulgarian Obligations and Contracts Act (Zakon za Zadalzheniata i Dogovorite – ZZD), the Bulgarian Consumer Protection Act, and applicable EU directives including the Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

The Company is registered as a tour operator in accordance with the Bulgarian Tourism Act. A copy of the Tour Operator Liability Insurance policy is filed annually with the Ministry of Tourism as required by Bulgarian law.

3. Acceptance of These Terms & Conditions

These Terms and Conditions constitute a legally binding contract between you and Montravel EOOD. By taking any of the following actions, you are deemed to have accepted these Terms and Conditions in full:

  • Completing and submitting a booking form on our website or by email.

  • Paying a deposit or full payment for any Tour.

  • Signing or electronically accepting any booking agreement, participation waiver, or contract issued by the Company.

  • Participating in any Tour or activity organized by the Company.

Where a booking is made on behalf of other participants (e.g., a group leader), the person making the booking warrants that they have the authority to bind all participants to these Terms and Conditions, and that all participants have been informed of and agree to these Terms and Conditions and any applicable activity waivers.

These Terms and Conditions take precedence over any prior verbal or written representations unless expressly stated otherwise in a signed written agreement.

4. Bookings, Reservations & Payments

4.1 Making a Booking

All bookings must be submitted in writing, either via our website booking form or by email to info@magicaltoursbulgaria.com. A booking is not confirmed until the Company issues a written Booking Confirmation and receives the required deposit or full payment.

The Company reserves the right to decline any booking at its absolute discretion without being required to provide a reason. If a booking is declined, any payments received will be returned in full within 14 days.

4.2 Deposit & Payment Schedule

  • A non-refundable deposit of 30% of the total tour price is required to confirm a booking, unless otherwise stated in writing.

  • The remaining balance is due no later than 30 days before the scheduled departure date.

  • For bookings made within 30 days of departure, full payment is due at the time of booking.

  • Failure to pay the balance by the due date may result in the booking being cancelled and the deposit being forfeited.

4.3 Prices & Currency

All prices are quoted in Euro (EUR) or Bulgarian Lev (BGN) as specified. The Company reserves the right to adjust prices prior to a Booking Confirmation being issued. Once a Booking Confirmation is issued, the price is fixed, except in the following circumstances:

  • Significant changes in transportation costs, including fuel prices.

  • Changes in taxes, fees, or levies imposed by applicable authorities.

  • Significant exchange rate fluctuations exceeding 2% against the quoted price.

Price increases of 8% or more of the total tour price will entitle the Client to cancel without penalty and receive a full refund. Price increases of less than 8% will not entitle the Client to cancel without penalty.

4.4 Accepted Payment Methods

The Company accepts payment by bank transfer, credit or debit card (via secure online payment processor), or cash for local day tours. Card payments may be subject to a processing fee, which will be disclosed at the time of booking. The Company does not store card details.

5. Cancellation Policy

5.1 Cancellation by the Client

All cancellations must be submitted in writing to info@magicaltoursbulgaria.com. The date of cancellation is the date on which the Company receives your written notification. The following cancellation fees apply:

We strongly recommend that all Clients purchase comprehensive travel insurance that includes cancellation cover. The Company cannot waive cancellation fees due to personal circumstances, illness, family emergencies, or any other reason, unless a separate written agreement has been made in advance.

5.2 Cancellation by the Company

The Company reserves the right to cancel any Tour in the following circumstances:

  • The minimum number of participants required to operate the Tour has not been reached. Clients will be notified at least 20 days before departure (7 days for short tours under 6 days) and offered either a full refund or an alternative tour of equivalent value.

  • Force Majeure events render operation of the Tour impossible, unsafe, or inadvisable. In this case, the Company will offer a full refund or an alternative tour, but shall not be liable for any additional costs incurred by the Client (e.g., flights, accommodation booked independently).

  • Safety concerns – including but not limited to dangerous weather, trail closure, government travel advisory, or other conditions deemed unsafe by the Company’s guides or management. Safety is our absolute priority.

The Company is not responsible for any consequential losses, including independently booked flights, accommodation, visas, or other travel arrangements, in the event of a Tour cancellation.

5.3 Modifications by the Client

Requests to change a booking (e.g., date, participant number) must be submitted in writing. The Company will endeavour to accommodate changes but cannot guarantee availability. An administration fee of BGN 30 (or EUR 15) per change per person may apply. Changes within 30 days of departure are treated as cancellations and new bookings.

5.4 Modifications by the Company

The Company reserves the right to modify Tour itineraries, accommodation, routes, or activity schedules where circumstances require. Where changes are significant, Clients will be notified as promptly as possible. A ‘significant change’ includes a change in departure/return dates of more than 24 hours, or a substantial change in the standard of accommodation or primary activities. In such cases, Clients may accept the changes or cancel and receive a full refund.

6. Travel Insurance

TRAVEL INSURANCE IS MANDATORY. All Clients must hold valid comprehensive travel insurance covering: personal accident and medical expenses, emergency evacuation and repatriation, trip cancellation and curtailment, loss of baggage and personal belongings, and liability to third parties. Participation in any Tour without adequate travel insurance is entirely at the Client’s own risk. The Company will not be liable for any costs that would have been covered by adequate insurance.

Proof of travel insurance may be requested by the Company prior to or at the start of the Tour. If a Client is unable to provide proof of adequate insurance, the Company reserves the right to refuse participation without any obligation to issue a refund.

For tours involving hiking, mountaineering, cave exploration, or other adventure activities, Clients must ensure their insurance policy specifically covers these activities. Standard travel insurance often excludes adventure sports – please check your policy carefully.

The Company holds Tour Operator Professional Liability Insurance as required by Article 97 of the Bulgarian Tourism Act. This policy covers the Company’s contractual liability to Clients but does not replace the Client’s obligation to hold personal travel insurance.

7. Client Responsibilities

7.1 General Obligations

All Clients are responsible for the following:

  • Ensuring they hold valid travel documents (passport, visa, ID card) as required for travel to Bulgaria and any other country included in the Tour.

  • Ensuring they meet the physical fitness and health requirements for their chosen Tour. The Company publishes fitness level descriptions for all Tours – Clients must assess these honestly.

  • Disclosing any medical conditions, disabilities, allergies, dietary requirements, or physical limitations that may affect participation in the Tour or the safety of others. The Company will treat such information confidentially.

  • Arriving at the agreed meeting point at the agreed time. The Company is not obliged to wait and will not issue refunds for late arrivals who miss a Tour.

  • Following all instructions given by Company guides and staff at all times. Failure to comply with guide instructions may result in removal from the Tour without refund.

  • Behaving in a manner that does not endanger themselves, other participants, guides, or third parties.

  • Respecting the natural environment, local laws, cultural customs, and protected areas visited during the Tour.

  • Carrying adequate personal equipment as specified in the Tour briefing (e.g., appropriate footwear, clothing, water, first aid supplies).

7.2 Physical Fitness & Medical Suitability

Many of our Tours involve strenuous physical activity including mountain hiking, steep ascents and descents, cave exploration in confined spaces, exposure to cold or wet conditions, and traversal of uneven terrain. By booking such a Tour, the Client represents and warrants that they are in good physical health and are not aware of any condition that would make participation unsafe.

Clients with pre-existing heart conditions, respiratory conditions, musculoskeletal problems, pregnancy, or any other condition that may be affected by strenuous exercise should consult their physician before booking and must disclose such conditions to the Company. The Company reserves the right to refuse participation if, in the reasonable opinion of its guides, a Client’s condition poses a risk to themselves or others.

7.3 Minors

Participants under the age of 18 must be accompanied by a parent or legal guardian, or must have a signed parental consent form authorizing their participation. The parent or guardian assumes full responsibility for the minor’s safety, behaviour, and compliance with these Terms and Conditions and any activity waivers. For tours involving adventure activities, we recommend that the suitability of the activity for the specific child is confirmed in advance with the Company.

8. Company Obligations & Service Standard

The Company commits to the following:

  • To organize and deliver Tours with reasonable skill, care, and diligence in accordance with the Bulgarian Tourism Act and applicable EU law.

  • To employ suitably qualified, licensed, and experienced guides for all Tours.

  • To provide accurate and up-to-date information about Tour content, difficulty level, and requirements.

  • To respond to Client enquiries within 2 working days.

  • To maintain Tour Operator Liability Insurance as required by law.

  • To notify Clients promptly of any significant changes to a confirmed booking.

  • To prioritize Client safety above all other considerations.

The Company acts as the principal organizer for its own Tours. Where Third-Party Suppliers are involved, the Company exercises reasonable care in their selection but cannot guarantee the performance of independent third parties.

9. Liability & Limitation of Liability

9.1 Company Liability

The Company is liable to Clients for the proper performance of the services covered by the booking contract, in accordance with Articles 88-102 of the Bulgarian Tourism Act and the EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

Where the Company is found to be liable for improper performance of contracted services, liability shall be limited as follows:

  • For personal injury or death caused directly by the gross negligence or wilful misconduct of the Company or its employees – unlimited liability applies.

  • For all other damages (property loss, consequential loss, disappointment, distress, loss of enjoyment) – liability is limited to the total price paid by the Client for the Tour.

  • For services provided by Third-Party Suppliers – liability is limited to the maximum available under the relevant international conventions and the Third-Party Supplier’s own terms.

In no event shall the Company be liable for indirect, consequential, special, or punitive damages, including loss of income, loss of enjoyment, or costs incurred in relation to independently booked travel arrangements (flights, accommodation, etc.) not forming part of the booked Tour.

9.2 Third-Party Suppliers

Where a Tour includes services provided by Third-Party Suppliers (such as accommodation providers, transport companies, external activity operators), the Company acts as an organizer and exercises reasonable care in selecting reliable suppliers. However, the Company cannot guarantee the actions, omissions, or quality of Third-Party Suppliers and shall not be liable for any loss, injury, or inconvenience arising from the acts or omissions of such suppliers, except to the extent required by the Bulgarian Tourism Act.

9.3 Exclusions from Liability

The Company shall not be liable for any loss, damage, injury, death, or inconvenience arising from:

  • Events of Force Majeure, as defined in Clause 1.

  • The Client’s own acts, omissions, or negligence.

  • The acts or omissions of a third party unconnected with the provision of the Tour.

  • Failure by the Client to follow guide instructions, safety briefings, or published Tour requirements.

  • The Client’s failure to disclose relevant medical conditions or physical limitations.

  • The Client’s failure to hold adequate travel insurance.

  • Inherent risks of the activities described in Clause 11 that are voluntarily assumed by the Client.

10. Force Majeure

The Company shall not be in breach of its obligations, nor shall it be liable for any failure or delay in performing its obligations, where such failure or delay results from a Force Majeure event. Force Majeure events include, but are not limited to:

  • Acts of God – earthquake, flood, fire, lightning, storm, landslide, avalanche, or other extreme natural events.

  • Epidemic, pandemic, or public health emergency declared by competent Bulgarian or international authorities.

  • War, armed conflict, terrorism, civil unrest, riot, or political instability.

  • Government action – travel bans, border closures, mandatory quarantine, or other regulatory restrictions.

  • Trail or road closures by relevant Bulgarian national park authorities, forestry services, or emergency services.

  • Extreme or dangerous weather conditions that, in the sole and reasonable judgment of the Company’s guides, render a Tour unsafe.

  • Industrial action, strikes, or failure of public utilities.

In the event of Force Majeure, the Company will endeavour to notify Clients as soon as reasonably practicable. The Company will offer alternative arrangements where possible, or a full refund of sums paid for the specific Tour affected. The Company shall not be responsible for any additional costs incurred by the Client (e.g., independently booked flights or accommodation) as a result of Force Majeure cancellations or modifications.

11. COVID-19, Pandemic & Infectious Disease Policy

This section applies to COVID-19 and any other infectious disease, epidemic, or pandemic that may affect the safe delivery of Tours or the health of participants and staff.

11.1 Client Health Declaration

By participating in any Tour, the Client confirms and warrants that:

  • To the best of their knowledge, they are not suffering from, and have not recently been diagnosed with, COVID-19 or any other highly contagious illness.

  • They have not been in close contact with a confirmed case of COVID-19 or other notifiable infectious disease within 10 days prior to the Tour departure date.

  • They will comply with all health and safety protocols required by Bulgarian law, national park regulations, or the Company at the time of the Tour.

  • They will immediately inform the Company or their guide if they develop symptoms of illness during a Tour.

11.2 Company Rights During a Health Emergency

The Company reserves the right to:

  • Refuse participation to any Client who presents symptoms of infectious illness at the time of the Tour, without obligation to issue a refund. This decision is made solely to protect the health and safety of other participants and staff.

  • Cancel, modify, or postpone any Tour in response to government-imposed restrictions, public health authority guidance, or border closures related to any infectious disease or public health emergency.

  • Require Clients to provide proof of vaccination, negative test results, or other documentation required by Bulgarian authorities as a condition of participation.

  • Implement additional safety protocols at any time (e.g., face coverings in enclosed spaces, reduced group sizes, enhanced sanitation) in compliance with Bulgarian health regulations.

11.3 Cancellation Due to Pandemic/Epidemic

If a Tour is cancelled or significantly modified by the Company as a direct result of a government-declared pandemic, epidemic, or public health emergency, the Client will be offered:

  • A full credit note redeemable against any future Tour within 24 months; or

  • A full refund of monies paid, less any unrecoverable costs already committed by the Company (e.g., pre-paid permits, guide fees), which will be documented and disclosed to the Client.

If a Client is unable or unwilling to participate in a Tour due to personal concern about infectious disease, and the Tour is not cancelled by the Company, the standard cancellation policy in Clause 5.1 will apply. The Company therefore strongly recommends purchasing travel insurance that covers ‘pandemic-related cancellation’.

11.4 Inherent Health Risks

Participation in outdoor activities in mountain, cave, and forest environments involves proximity to other participants and, occasionally, to members of the public. The Company cannot guarantee a risk-free environment with respect to infectious diseases. The Client assumes this inherent risk by choosing to participate.

12. Adventure Activity Disclaimer & Assumption of Risk

WARNING – PLEASE READ CAREFULLY: The activities offered by Magical Tours Bulgaria include hiking in mountain terrain, cave exploration, forest trekking, and other adventure activities that carry inherent risks of personal injury, illness, or death that cannot be fully eliminated even with expert guidance and proper precautions. You must read and understand this section before booking.

12.1 Inherent Risks of Mountain Hiking

Mountain hiking in the Bulgarian Balkans, Rila, Rhodopes, and other mountain regions involves, but is not limited to, the following inherent risks:

  • Falls on steep, rocky, wet, or icy terrain, which may result in injury or death.

  • Rockfall, landslide, or avalanche in mountain and gorge environments.

  • Sudden and severe changes in weather conditions, including thunderstorms, strong winds, fog, hail, and rapid temperature drops.

  • Altitude-related symptoms including fatigue, dehydration, and altitude sickness on higher peaks.

  • Lightning strikes in exposed alpine terrain.

  • Hypothermia or frostbite in cold or wet conditions.

  • Muscle injury, sprains, fractures, or other physical injury from terrain challenges.

  • Encounters with wildlife, including venomous snakes, insects, and bears in certain areas.

  • Difficulty of evacuation in remote terrain – rescue may take several hours.

12.2 Inherent Risks of Cave & Gorge Exploration

Cave tours, gorge crossings, and subterranean activities involve additional risks, including:

  • Slippery and uneven surfaces in caves and gorges, significantly increasing the risk of falls.

  • Low clearance areas and confined spaces requiring crawling, crouching, or squeezing.

  • Darkness and limited visibility in underground environments.

  • Risk of flash flooding in cave and gorge systems following rain.

  • Potential for entrapment or disorientation in underground environments.

  • Falling rocks or debris from cave ceilings and gorge walls.

  • Cold and damp conditions that may affect those with respiratory or circulatory conditions.

12.3 Voluntary Assumption of Risk

By booking and participating in any Tour offered by Magical Tours Bulgaria, the Client expressly:

  1. Acknowledges that they are fully aware of the inherent risks of the specific activity they have chosen, including all risks described in Clauses 12.1 and 12.2 and any risks described in the specific Tour itinerary.

  2. Accepts and voluntarily assumes all inherent risks associated with the Tour and its activities, including risks arising from the negligence (but not gross negligence or wilful misconduct) of the Company, its employees, agents, or guides.

  3. Agrees that they have assessed their own physical fitness, experience, and capabilities against the published Tour requirements and have determined, in their own judgment, that participation is appropriate for them.

  4. Agrees to follow all safety instructions, guidelines, and decisions made by Company guides without argument or delay. Guide decisions on safety matters are final.

  5. Agrees that if they choose to leave a Tour, proceed beyond designated points, or engage in activities against guide advice, they do so entirely at their own risk and release the Company from all liability for any resulting loss, injury, or death.

Nothing in this Clause shall exclude or limit the Company’s liability for death or personal injury caused by the gross negligence or wilful misconduct of the Company or its employees, as provided by Bulgarian law.

12.4 Equipment & Preparation

Clients must arrive at each Tour with appropriate personal equipment as specified in the Tour briefing. The Company may refuse entry to any Client who arrives inappropriately equipped (e.g., wearing unsuitable footwear for a mountain hike). No refund will be issued in such circumstances. The Company is not responsible for any loss, damage, or injury arising from inadequate personal equipment.

12.5 Guide Authority on Safety

All decisions regarding the safety of a Tour – including the decision to modify a route, turn back, halt a Tour, or exclude a participant – rest solely with the Company’s guide. These decisions are made with the safety of all participants in mind and are not negotiable. Clients who refuse to comply with a guide’s safety decision may be excluded from the Tour without refund.

13. Complaints & Dispute Resolution

13.1 Complaints During a Tour

If you have a complaint about any aspect of your Tour, you must raise it immediately with your guide or Company representative. Prompt notification allows the Company the opportunity to rectify the problem. The Company cannot consider complaints relating to matters that were not raised on-tour unless there was a compelling reason that prevented you from doing so.

13.2 Formal Complaints

Formal complaints must be submitted in writing to info@magicaltoursbulgaria.com within 28 days of the end of the Tour. The Company will acknowledge receipt within 5 working days and provide a full response within 28 days. Complaints received more than 28 days after the Tour ends will not normally be considered.

13.3 External Dispute Resolution

If a complaint is not resolved to your satisfaction, you have the following options:

  • Lodge a complaint with the Commission for Consumer Protection (CCP) of Bulgaria, the competent authority for consumer rights: Sofia 1000, 4A Slaveykov Square – www.kzp.bg.

  • Contact the European Online Dispute Resolution platform (for online contracts): www.ec.europa.eu/consumers/odr.

  • Pursue a claim through the Bulgarian courts. The governing law is Bulgarian law and the courts of the Republic of Bulgaria shall have exclusive jurisdiction.

14. Intellectual Property & Photography

All content on the Company’s website and marketing materials – including photographs, videos, written descriptions, route maps, and itineraries – is the property of Montravel EOOD or used with permission. No content may be reproduced, distributed, or used commercially without the prior written consent of the Company.

During Tours, the Company’s guides or staff may take photographs or video footage for marketing and social media purposes. By participating in a Tour, you grant the Company permission to use such images and footage, in which you may appear, for non-commercial promotional purposes. If you do not wish to be photographed, please inform your guide at the start of the Tour. Images of identifiable individuals will be handled in accordance with our Privacy Policy.

15. Data Protection

The Company collects and processes personal data in accordance with EU Regulation 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act. By making a booking, you consent to the Company processing the personal data necessary to fulfil your booking and comply with legal obligations. Your data will not be sold to third parties.

16. Health, Safety & Environmental Responsibility

The Company is committed to the safety of its Clients, guides, and the natural environment. All Clients are expected to:

  • Carry sufficient water (minimum 2 litres per person for mountain tours), personal medication, and emergency snacks.

  • Inform the guide of any medical condition, allergy, or medication that may become relevant during the Tour.

  • Not consume alcohol before or during strenuous outdoor activities. Any Client who is visibly intoxicated will be excluded from the Tour without refund.

  • Not smoke in forested areas, national parks, or any locations where smoking is prohibited by Bulgarian law.

  • Take all litter home or to designated disposal points. The Company practices Leave No Trace principles.

  • Respect wildlife and adhere to national park regulations. Feeding or disturbing wildlife is strictly prohibited.

  • Not deviate from designated routes without explicit guide permission.

17. Governing Law & Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Bulgaria. The parties submit to the exclusive jurisdiction of the Bulgarian courts for the resolution of any dispute arising out of or in connection with these Terms and Conditions.

Applicable legislation includes, but is not limited to:

  • Bulgarian Tourism Act (Zakon za Turizma) – as amended.

  • Bulgarian Obligations and Contracts Act (Zakon za Zadazheniata i Dogovorite).

  • Bulgarian Consumer Protection Act.

  • EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

  • EU General Data Protection Regulation 2016/679 (GDPR).

If any provision of these Terms and Conditions is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Amendments to These Terms & Conditions

The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the Company’s website with a revised effective date. The Terms and Conditions applicable to any confirmed booking are those in force at the time the Booking Confirmation was issued, except where changes are required by law or by material changes in circumstances affecting the Tour.

19. Entire Agreement

These Terms and Conditions, together with the Booking Confirmation, any activity-specific participation waivers, and the Company’s Privacy Policy, constitute the entire agreement between the Client and the Company with respect to the Tour. They supersede all prior representations, negotiations, understandings, and agreements, whether oral or written.

No variation to these Terms and Conditions shall be effective unless made in writing and signed by an authorized representative of Montravel EOOD.

1. Definitions & Interpretation

In these Terms and Conditions, the following definitions apply:

  • “Company”, “We”, “Us”, “Our” – Montravel EOOD, a limited liability company incorporated under Bulgarian law (EOOD), trading as Magical Tours Bulgaria, with registered address at 17 G. Benkovski Str., Dulovo 7650, Bulgaria.

  • “Client”, “You”, “Your” – any individual or group who books, purchases, or participates in any tour, activity, or service offered by the Company.

  • “Tour” – any guided excursion, hiking trip, cave tour, nature walk, mountain activity, day trip, multi-day package, or other tourist service arranged by the Company.

  • “Booking” – a confirmed reservation made by the Client for a Tour, accepted in writing (including email) by the Company.

  • “Booking Confirmation” – the written or electronic document issued by the Company confirming acceptance of a Booking.

  • “Force Majeure” – any event beyond the reasonable control of the Company, including but not limited to acts of God, extreme weather, earthquakes, floods, fire, epidemic, pandemic, government action, war, terrorism, civil unrest, border closure, or infrastructure failure.

  • “Third-Party Supplier” – any independent accommodation provider, transport company, guide, activity operator, or other service provider contracted by the Company to deliver elements of a Tour.

  • “Package” – a combination of at least two different types of tourist services sold as a single arrangement, as defined in the Bulgarian Tourism Act.

  • “Inherent Risk” – risks that are an integral feature of an activity and cannot be eliminated without fundamentally changing the nature of the activity, including the risks described in Clause 11.

These Terms and Conditions are governed by the laws of the Republic of Bulgaria, including the Bulgarian Tourism Act (Zakon za Turizma), the Bulgarian Obligations and Contracts Act (Zakon za Zadalzheniata i Dogovorite – ZZD), the Bulgarian Consumer Protection Act, and applicable EU directives including the Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

The Company is registered as a tour operator in accordance with the Bulgarian Tourism Act. A copy of the Tour Operator Liability Insurance policy is filed annually with the Ministry of Tourism as required by Bulgarian law.

3. Acceptance of These Terms & Conditions

These Terms and Conditions constitute a legally binding contract between you and Montravel EOOD. By taking any of the following actions, you are deemed to have accepted these Terms and Conditions in full:

  • Completing and submitting a booking form on our website or by email.

  • Paying a deposit or full payment for any Tour.

  • Signing or electronically accepting any booking agreement, participation waiver, or contract issued by the Company.

  • Participating in any Tour or activity organized by the Company.

Where a booking is made on behalf of other participants (e.g., a group leader), the person making the booking warrants that they have the authority to bind all participants to these Terms and Conditions, and that all participants have been informed of and agree to these Terms and Conditions and any applicable activity waivers.

These Terms and Conditions take precedence over any prior verbal or written representations unless expressly stated otherwise in a signed written agreement.

4. Bookings, Reservations & Payments

4.1 Making a Booking

All bookings must be submitted in writing, either via our website booking form or by email to info@magicaltoursbulgaria.com. A booking is not confirmed until the Company issues a written Booking Confirmation and receives the required deposit or full payment.

The Company reserves the right to decline any booking at its absolute discretion without being required to provide a reason. If a booking is declined, any payments received will be returned in full within 14 days.

4.2 Deposit & Payment Schedule

  • A non-refundable deposit of 30% of the total tour price is required to confirm a booking, unless otherwise stated in writing.

  • The remaining balance is due no later than 30 days before the scheduled departure date.

  • For bookings made within 30 days of departure, full payment is due at the time of booking.

  • Failure to pay the balance by the due date may result in the booking being cancelled and the deposit being forfeited.

4.3 Prices & Currency

All prices are quoted in Euro (EUR) or Bulgarian Lev (BGN) as specified. The Company reserves the right to adjust prices prior to a Booking Confirmation being issued. Once a Booking Confirmation is issued, the price is fixed, except in the following circumstances:

  • Significant changes in transportation costs, including fuel prices.

  • Changes in taxes, fees, or levies imposed by applicable authorities.

  • Significant exchange rate fluctuations exceeding 2% against the quoted price.

Price increases of 8% or more of the total tour price will entitle the Client to cancel without penalty and receive a full refund. Price increases of less than 8% will not entitle the Client to cancel without penalty.

4.4 Accepted Payment Methods

The Company accepts payment by bank transfer, credit or debit card (via secure online payment processor), or cash for local day tours. Card payments may be subject to a processing fee, which will be disclosed at the time of booking. The Company does not store card details.

5. Cancellation Policy

5.1 Cancellation by the Client

All cancellations must be submitted in writing to info@magicaltoursbulgaria.com. The date of cancellation is the date on which the Company receives your written notification. The following cancellation fees apply:

We strongly recommend that all Clients purchase comprehensive travel insurance that includes cancellation cover. The Company cannot waive cancellation fees due to personal circumstances, illness, family emergencies, or any other reason, unless a separate written agreement has been made in advance.

5.2 Cancellation by the Company

The Company reserves the right to cancel any Tour in the following circumstances:

  • The minimum number of participants required to operate the Tour has not been reached. Clients will be notified at least 20 days before departure (7 days for short tours under 6 days) and offered either a full refund or an alternative tour of equivalent value.

  • Force Majeure events render operation of the Tour impossible, unsafe, or inadvisable. In this case, the Company will offer a full refund or an alternative tour, but shall not be liable for any additional costs incurred by the Client (e.g., flights, accommodation booked independently).

  • Safety concerns – including but not limited to dangerous weather, trail closure, government travel advisory, or other conditions deemed unsafe by the Company’s guides or management. Safety is our absolute priority.

The Company is not responsible for any consequential losses, including independently booked flights, accommodation, visas, or other travel arrangements, in the event of a Tour cancellation.

5.3 Modifications by the Client

Requests to change a booking (e.g., date, participant number) must be submitted in writing. The Company will endeavour to accommodate changes but cannot guarantee availability. An administration fee of BGN 30 (or EUR 15) per change per person may apply. Changes within 30 days of departure are treated as cancellations and new bookings.

5.4 Modifications by the Company

The Company reserves the right to modify Tour itineraries, accommodation, routes, or activity schedules where circumstances require. Where changes are significant, Clients will be notified as promptly as possible. A ‘significant change’ includes a change in departure/return dates of more than 24 hours, or a substantial change in the standard of accommodation or primary activities. In such cases, Clients may accept the changes or cancel and receive a full refund.

6. Travel Insurance

TRAVEL INSURANCE IS MANDATORY. All Clients must hold valid comprehensive travel insurance covering: personal accident and medical expenses, emergency evacuation and repatriation, trip cancellation and curtailment, loss of baggage and personal belongings, and liability to third parties. Participation in any Tour without adequate travel insurance is entirely at the Client’s own risk. The Company will not be liable for any costs that would have been covered by adequate insurance.

Proof of travel insurance may be requested by the Company prior to or at the start of the Tour. If a Client is unable to provide proof of adequate insurance, the Company reserves the right to refuse participation without any obligation to issue a refund.

For tours involving hiking, mountaineering, cave exploration, or other adventure activities, Clients must ensure their insurance policy specifically covers these activities. Standard travel insurance often excludes adventure sports – please check your policy carefully.

The Company holds Tour Operator Professional Liability Insurance as required by Article 97 of the Bulgarian Tourism Act. This policy covers the Company’s contractual liability to Clients but does not replace the Client’s obligation to hold personal travel insurance.

7. Client Responsibilities

7.1 General Obligations

All Clients are responsible for the following:

  • Ensuring they hold valid travel documents (passport, visa, ID card) as required for travel to Bulgaria and any other country included in the Tour.

  • Ensuring they meet the physical fitness and health requirements for their chosen Tour. The Company publishes fitness level descriptions for all Tours – Clients must assess these honestly.

  • Disclosing any medical conditions, disabilities, allergies, dietary requirements, or physical limitations that may affect participation in the Tour or the safety of others. The Company will treat such information confidentially.

  • Arriving at the agreed meeting point at the agreed time. The Company is not obliged to wait and will not issue refunds for late arrivals who miss a Tour.

  • Following all instructions given by Company guides and staff at all times. Failure to comply with guide instructions may result in removal from the Tour without refund.

  • Behaving in a manner that does not endanger themselves, other participants, guides, or third parties.

  • Respecting the natural environment, local laws, cultural customs, and protected areas visited during the Tour.

  • Carrying adequate personal equipment as specified in the Tour briefing (e.g., appropriate footwear, clothing, water, first aid supplies).

7.2 Physical Fitness & Medical Suitability

Many of our Tours involve strenuous physical activity including mountain hiking, steep ascents and descents, cave exploration in confined spaces, exposure to cold or wet conditions, and traversal of uneven terrain. By booking such a Tour, the Client represents and warrants that they are in good physical health and are not aware of any condition that would make participation unsafe.

Clients with pre-existing heart conditions, respiratory conditions, musculoskeletal problems, pregnancy, or any other condition that may be affected by strenuous exercise should consult their physician before booking and must disclose such conditions to the Company. The Company reserves the right to refuse participation if, in the reasonable opinion of its guides, a Client’s condition poses a risk to themselves or others.

7.3 Minors

Participants under the age of 18 must be accompanied by a parent or legal guardian, or must have a signed parental consent form authorizing their participation. The parent or guardian assumes full responsibility for the minor’s safety, behaviour, and compliance with these Terms and Conditions and any activity waivers. For tours involving adventure activities, we recommend that the suitability of the activity for the specific child is confirmed in advance with the Company.

8. Company Obligations & Service Standard

The Company commits to the following:

  • To organize and deliver Tours with reasonable skill, care, and diligence in accordance with the Bulgarian Tourism Act and applicable EU law.

  • To employ suitably qualified, licensed, and experienced guides for all Tours.

  • To provide accurate and up-to-date information about Tour content, difficulty level, and requirements.

  • To respond to Client enquiries within 2 working days.

  • To maintain Tour Operator Liability Insurance as required by law.

  • To notify Clients promptly of any significant changes to a confirmed booking.

  • To prioritize Client safety above all other considerations.

The Company acts as the principal organizer for its own Tours. Where Third-Party Suppliers are involved, the Company exercises reasonable care in their selection but cannot guarantee the performance of independent third parties.

9. Liability & Limitation of Liability

9.1 Company Liability

The Company is liable to Clients for the proper performance of the services covered by the booking contract, in accordance with Articles 88-102 of the Bulgarian Tourism Act and the EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

Where the Company is found to be liable for improper performance of contracted services, liability shall be limited as follows:

  • For personal injury or death caused directly by the gross negligence or wilful misconduct of the Company or its employees – unlimited liability applies.

  • For all other damages (property loss, consequential loss, disappointment, distress, loss of enjoyment) – liability is limited to the total price paid by the Client for the Tour.

  • For services provided by Third-Party Suppliers – liability is limited to the maximum available under the relevant international conventions and the Third-Party Supplier’s own terms.

In no event shall the Company be liable for indirect, consequential, special, or punitive damages, including loss of income, loss of enjoyment, or costs incurred in relation to independently booked travel arrangements (flights, accommodation, etc.) not forming part of the booked Tour.

9.2 Third-Party Suppliers

Where a Tour includes services provided by Third-Party Suppliers (such as accommodation providers, transport companies, external activity operators), the Company acts as an organizer and exercises reasonable care in selecting reliable suppliers. However, the Company cannot guarantee the actions, omissions, or quality of Third-Party Suppliers and shall not be liable for any loss, injury, or inconvenience arising from the acts or omissions of such suppliers, except to the extent required by the Bulgarian Tourism Act.

9.3 Exclusions from Liability

The Company shall not be liable for any loss, damage, injury, death, or inconvenience arising from:

  • Events of Force Majeure, as defined in Clause 1.

  • The Client’s own acts, omissions, or negligence.

  • The acts or omissions of a third party unconnected with the provision of the Tour.

  • Failure by the Client to follow guide instructions, safety briefings, or published Tour requirements.

  • The Client’s failure to disclose relevant medical conditions or physical limitations.

  • The Client’s failure to hold adequate travel insurance.

  • Inherent risks of the activities described in Clause 11 that are voluntarily assumed by the Client.

10. Force Majeure

The Company shall not be in breach of its obligations, nor shall it be liable for any failure or delay in performing its obligations, where such failure or delay results from a Force Majeure event. Force Majeure events include, but are not limited to:

  • Acts of God – earthquake, flood, fire, lightning, storm, landslide, avalanche, or other extreme natural events.

  • Epidemic, pandemic, or public health emergency declared by competent Bulgarian or international authorities.

  • War, armed conflict, terrorism, civil unrest, riot, or political instability.

  • Government action – travel bans, border closures, mandatory quarantine, or other regulatory restrictions.

  • Trail or road closures by relevant Bulgarian national park authorities, forestry services, or emergency services.

  • Extreme or dangerous weather conditions that, in the sole and reasonable judgment of the Company’s guides, render a Tour unsafe.

  • Industrial action, strikes, or failure of public utilities.

In the event of Force Majeure, the Company will endeavour to notify Clients as soon as reasonably practicable. The Company will offer alternative arrangements where possible, or a full refund of sums paid for the specific Tour affected. The Company shall not be responsible for any additional costs incurred by the Client (e.g., independently booked flights or accommodation) as a result of Force Majeure cancellations or modifications.

11. COVID-19, Pandemic & Infectious Disease Policy

This section applies to COVID-19 and any other infectious disease, epidemic, or pandemic that may affect the safe delivery of Tours or the health of participants and staff.

11.1 Client Health Declaration

By participating in any Tour, the Client confirms and warrants that:

  • To the best of their knowledge, they are not suffering from, and have not recently been diagnosed with, COVID-19 or any other highly contagious illness.

  • They have not been in close contact with a confirmed case of COVID-19 or other notifiable infectious disease within 10 days prior to the Tour departure date.

  • They will comply with all health and safety protocols required by Bulgarian law, national park regulations, or the Company at the time of the Tour.

  • They will immediately inform the Company or their guide if they develop symptoms of illness during a Tour.

11.2 Company Rights During a Health Emergency

The Company reserves the right to:

  • Refuse participation to any Client who presents symptoms of infectious illness at the time of the Tour, without obligation to issue a refund. This decision is made solely to protect the health and safety of other participants and staff.

  • Cancel, modify, or postpone any Tour in response to government-imposed restrictions, public health authority guidance, or border closures related to any infectious disease or public health emergency.

  • Require Clients to provide proof of vaccination, negative test results, or other documentation required by Bulgarian authorities as a condition of participation.

  • Implement additional safety protocols at any time (e.g., face coverings in enclosed spaces, reduced group sizes, enhanced sanitation) in compliance with Bulgarian health regulations.

11.3 Cancellation Due to Pandemic/Epidemic

If a Tour is cancelled or significantly modified by the Company as a direct result of a government-declared pandemic, epidemic, or public health emergency, the Client will be offered:

  • A full credit note redeemable against any future Tour within 24 months; or

  • A full refund of monies paid, less any unrecoverable costs already committed by the Company (e.g., pre-paid permits, guide fees), which will be documented and disclosed to the Client.

If a Client is unable or unwilling to participate in a Tour due to personal concern about infectious disease, and the Tour is not cancelled by the Company, the standard cancellation policy in Clause 5.1 will apply. The Company therefore strongly recommends purchasing travel insurance that covers ‘pandemic-related cancellation’.

11.4 Inherent Health Risks

Participation in outdoor activities in mountain, cave, and forest environments involves proximity to other participants and, occasionally, to members of the public. The Company cannot guarantee a risk-free environment with respect to infectious diseases. The Client assumes this inherent risk by choosing to participate.

12. Adventure Activity Disclaimer & Assumption of Risk

WARNING – PLEASE READ CAREFULLY: The activities offered by Magical Tours Bulgaria include hiking in mountain terrain, cave exploration, forest trekking, and other adventure activities that carry inherent risks of personal injury, illness, or death that cannot be fully eliminated even with expert guidance and proper precautions. You must read and understand this section before booking.

12.1 Inherent Risks of Mountain Hiking

Mountain hiking in the Bulgarian Balkans, Rila, Rhodopes, and other mountain regions involves, but is not limited to, the following inherent risks:

  • Falls on steep, rocky, wet, or icy terrain, which may result in injury or death.

  • Rockfall, landslide, or avalanche in mountain and gorge environments.

  • Sudden and severe changes in weather conditions, including thunderstorms, strong winds, fog, hail, and rapid temperature drops.

  • Altitude-related symptoms including fatigue, dehydration, and altitude sickness on higher peaks.

  • Lightning strikes in exposed alpine terrain.

  • Hypothermia or frostbite in cold or wet conditions.

  • Muscle injury, sprains, fractures, or other physical injury from terrain challenges.

  • Encounters with wildlife, including venomous snakes, insects, and bears in certain areas.

  • Difficulty of evacuation in remote terrain – rescue may take several hours.

12.2 Inherent Risks of Cave & Gorge Exploration

Cave tours, gorge crossings, and subterranean activities involve additional risks, including:

  • Slippery and uneven surfaces in caves and gorges, significantly increasing the risk of falls.

  • Low clearance areas and confined spaces requiring crawling, crouching, or squeezing.

  • Darkness and limited visibility in underground environments.

  • Risk of flash flooding in cave and gorge systems following rain.

  • Potential for entrapment or disorientation in underground environments.

  • Falling rocks or debris from cave ceilings and gorge walls.

  • Cold and damp conditions that may affect those with respiratory or circulatory conditions.

12.3 Voluntary Assumption of Risk

By booking and participating in any Tour offered by Magical Tours Bulgaria, the Client expressly:

  1. Acknowledges that they are fully aware of the inherent risks of the specific activity they have chosen, including all risks described in Clauses 12.1 and 12.2 and any risks described in the specific Tour itinerary.

  2. Accepts and voluntarily assumes all inherent risks associated with the Tour and its activities, including risks arising from the negligence (but not gross negligence or wilful misconduct) of the Company, its employees, agents, or guides.

  3. Agrees that they have assessed their own physical fitness, experience, and capabilities against the published Tour requirements and have determined, in their own judgment, that participation is appropriate for them.

  4. Agrees to follow all safety instructions, guidelines, and decisions made by Company guides without argument or delay. Guide decisions on safety matters are final.

  5. Agrees that if they choose to leave a Tour, proceed beyond designated points, or engage in activities against guide advice, they do so entirely at their own risk and release the Company from all liability for any resulting loss, injury, or death.

Nothing in this Clause shall exclude or limit the Company’s liability for death or personal injury caused by the gross negligence or wilful misconduct of the Company or its employees, as provided by Bulgarian law.

12.4 Equipment & Preparation

Clients must arrive at each Tour with appropriate personal equipment as specified in the Tour briefing. The Company may refuse entry to any Client who arrives inappropriately equipped (e.g., wearing unsuitable footwear for a mountain hike). No refund will be issued in such circumstances. The Company is not responsible for any loss, damage, or injury arising from inadequate personal equipment.

12.5 Guide Authority on Safety

All decisions regarding the safety of a Tour – including the decision to modify a route, turn back, halt a Tour, or exclude a participant – rest solely with the Company’s guide. These decisions are made with the safety of all participants in mind and are not negotiable. Clients who refuse to comply with a guide’s safety decision may be excluded from the Tour without refund.

13. Complaints & Dispute Resolution

13.1 Complaints During a Tour

If you have a complaint about any aspect of your Tour, you must raise it immediately with your guide or Company representative. Prompt notification allows the Company the opportunity to rectify the problem. The Company cannot consider complaints relating to matters that were not raised on-tour unless there was a compelling reason that prevented you from doing so.

13.2 Formal Complaints

Formal complaints must be submitted in writing to info@magicaltoursbulgaria.com within 28 days of the end of the Tour. The Company will acknowledge receipt within 5 working days and provide a full response within 28 days. Complaints received more than 28 days after the Tour ends will not normally be considered.

13.3 External Dispute Resolution

If a complaint is not resolved to your satisfaction, you have the following options:

  • Lodge a complaint with the Commission for Consumer Protection (CCP) of Bulgaria, the competent authority for consumer rights: Sofia 1000, 4A Slaveykov Square – www.kzp.bg.

  • Contact the European Online Dispute Resolution platform (for online contracts): www.ec.europa.eu/consumers/odr.

  • Pursue a claim through the Bulgarian courts. The governing law is Bulgarian law and the courts of the Republic of Bulgaria shall have exclusive jurisdiction.

14. Intellectual Property & Photography

All content on the Company’s website and marketing materials – including photographs, videos, written descriptions, route maps, and itineraries – is the property of Montravel EOOD or used with permission. No content may be reproduced, distributed, or used commercially without the prior written consent of the Company.

During Tours, the Company’s guides or staff may take photographs or video footage for marketing and social media purposes. By participating in a Tour, you grant the Company permission to use such images and footage, in which you may appear, for non-commercial promotional purposes. If you do not wish to be photographed, please inform your guide at the start of the Tour. Images of identifiable individuals will be handled in accordance with our Privacy Policy.

15. Data Protection

The Company collects and processes personal data in accordance with EU Regulation 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act. By making a booking, you consent to the Company processing the personal data necessary to fulfil your booking and comply with legal obligations. Your data will not be sold to third parties.

16. Health, Safety & Environmental Responsibility

The Company is committed to the safety of its Clients, guides, and the natural environment. All Clients are expected to:

  • Carry sufficient water (minimum 2 litres per person for mountain tours), personal medication, and emergency snacks.

  • Inform the guide of any medical condition, allergy, or medication that may become relevant during the Tour.

  • Not consume alcohol before or during strenuous outdoor activities. Any Client who is visibly intoxicated will be excluded from the Tour without refund.

  • Not smoke in forested areas, national parks, or any locations where smoking is prohibited by Bulgarian law.

  • Take all litter home or to designated disposal points. The Company practices Leave No Trace principles.

  • Respect wildlife and adhere to national park regulations. Feeding or disturbing wildlife is strictly prohibited.

  • Not deviate from designated routes without explicit guide permission.

17. Governing Law & Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Bulgaria. The parties submit to the exclusive jurisdiction of the Bulgarian courts for the resolution of any dispute arising out of or in connection with these Terms and Conditions.

Applicable legislation includes, but is not limited to:

  • Bulgarian Tourism Act (Zakon za Turizma) – as amended.

  • Bulgarian Obligations and Contracts Act (Zakon za Zadazheniata i Dogovorite).

  • Bulgarian Consumer Protection Act.

  • EU Package Travel Directive (EU) 2015/2302 as transposed into Bulgarian law.

  • EU General Data Protection Regulation 2016/679 (GDPR).

If any provision of these Terms and Conditions is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Amendments to These Terms & Conditions

The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the Company’s website with a revised effective date. The Terms and Conditions applicable to any confirmed booking are those in force at the time the Booking Confirmation was issued, except where changes are required by law or by material changes in circumstances affecting the Tour.

19. Entire Agreement

These Terms and Conditions, together with the Booking Confirmation, any activity-specific participation waivers, and the Company’s Privacy Policy, constitute the entire agreement between the Client and the Company with respect to the Tour. They supersede all prior representations, negotiations, understandings, and agreements, whether oral or written.

No variation to these Terms and Conditions shall be effective unless made in writing and signed by an authorized representative of Montravel EOOD.
